When a Family Member Has a Disability, Get the Support You Need

Folks in Oklahoma know nothing means more than family. We watch children grow, we care for our parents as they age, and we’re there for our spouses when their health takes a turn.

Caring for an ailing family member is some of the toughest, most important, work you’ll do. Social Security Disability benefits can help when a person you love can’t work and the monthly bills start to pile up.

You can help them apply for disability benefits or fight for an appeal after benefits a denial.

You can help get benefits for:

    • Spouses (Social Security Disability Insurance, SSDI, when they have to stop working)
    • Underage children (Supplemental Security Income, SSI, benefits)
    • Adult children whose disabilities prevent them from working (SSDI benefits based on your work record under Social Security)

As a caregiver, you may also be eligible for additional benefits to help stabilize your life while you take care of a family member. These benefits differ from situation to situation.

Benefits provide monthly income and access to Medicare or Medicaid health coverage.

But you have to jump through all the hoops and gather all the evidence you would if you were applying yourself. It’s a lot for anyone to handle.

The disability lawyers at Troutman & Troutman know what you’re going through. We are a disability law firm founded by an Oklahoma family dedicated to helping other Oklahoma families.

Since 1993, we’ve helped thousands of families win the benefits to stabilize their lives in the face of life-altering health problems.

Can I Get Social Security Disability Benefits as a Caregiver?

When a spouse or a child is sick, they’re not the only ones dealing with life’s challenges. Long-term illness impacts the whole family.

    That includes you.

In certain situations, Social Security recognizes the financial burden on caregivers who depend on the income of a family member who’s been sidelined by illness.

    Eligible family members include:

    • Spouses: If you are over 62 or caring for your spouse’s child who is either under 16 or also has a qualifying disability, you may be able to claim benefits.
    • Children: A child under 18 whose parent qualifies for disability benefits can also get dependent benefits.
    • Disabled adult children: An adult who develops a disability before age 22 and was never able to work enough to build a Social Security record of their own may qualify under their parent’s Social Security history.
    • Divorced spouses: If you were married at least 10 years, haven’t remarried, and cannot receive higher Social Security benefits on your own, you could get benefits under your former spouse’s Social Security record.

Under these limited circumstances, you can receive up to an additional 50% of the amount of your family member’s disability benefits. There is a total family limit, however, of 150 to 180% of what the original benefits recipient gets.

Understanding the moving parts is where a disability lawyer can be a real asset.
