My name is Darren Rackley. I primarily handle the federal court appeals here at Troutman & Troutman. Occasionally, very rarely, someone will be denied at all three levels before the agency. Once they’ve been denied at the initial level, reconsideration, and then at the hearing level, their next option is to file a civil action in federal district court. That’s where I come in. There’s nothing they need to do other than contact us as soon as possible after they’ve been denied.
On appeal, if the evidence is so compelling or if the case has been through federal court before at least twice, I can ask for the payment of benefits, which in that case, the court may grant benefits immediately and they would not have to go back for another hearing.
