How Much Are Attorney Fees In Disability Cases?

Tulsa SSDI Lawyer On Contingency Fees

All too often, people shy away from the idea of hiring a disability attorney to handle an SSDI case because they think it is too expensive. In this video, SSDI lawyer Steve Troutman explains contingency fees and reviews the actual costs of legal representation.

Our fees are contingent and essentially a percentage of the past-due benefits that the person gets. You only get paid if you win. So if I take somebody’s case on, and I’m unable to get benefits for them, they don’t owe me a fee. If we are successful in their case, Social Security, at the time they make that decision, calculates how much benefits they already owe the person up to that point in time. Social Security refers to that as the past-due benefits; most people just think of it as their back pay. Our fee is the lesser of 25% of their back pay or $6,000. It’s currently $6,000 dollars. Social Security, every few years, may increase the maximum, but the current maximum is $6,000. For some reason, people always have that number in their head and think I always get a $6,000 fee, that’s not the case. It’s the lesser of 25% or $6,000. We don’t get any of the future benefits. Once their disability starts, all the future benefits are theirs.
