Can Wounded Warriors Collect Social Security Disability?

Are you a Wounded Warrior? First, let us thank you for your service. You are the backbone to our country—without your dedication and commitment, citizens would not have the rights they currently enjoy.

Second, understand that you should not feel ashamed about receiving benefits relating to your injuries. If your injuries are severe enough that you have 100 percent Permanent and Total (P&T) rating by the Veterans Administration, you may be able to obtain Social Security Disability Insurance (SSDI).

If you are a Wounded Warrior, you should know that the Social Security Administration uses an “all or nothing” approach when it comes to determining whether a person qualifies for SSDI.

If you are receiving benefits because the VA considers you a lower percent of disabled, you may want to speak to an attorney about obtaining benefits. In most cases to obtain SSDI, you must suffer from a disability that is expected to last longer than 12 months and could result in death. Therefore, veterans who may be labeled 50 to 60 percent disabled by the VA may not qualify for benefits.

If you suffer from immense disabilities, keep in mind it is possible for many veterans to structure their VA benefit payments to minimize the impact that the benefits will have on SSDI benefits. Meaning, by working with an attorney, you can devise a way to receive the maximum amount of money possible.

I am a Veteran. Should I Speak to an Attorney About Social Security Disability?

It should also be noted that last year the SSA began to streamline its review of disability claims for veterans, allowing those who are deemed fully disabled by the VA to experience an expedited benefit determination process.

If you are a veteran and you have questions about applying for disability benefits, contact a Tulsa Social Security disability attorney. Visit our Social Security FAQ page if you have questions about this process, as the process can be confusing.

We also offer a page for veterans, in which we discuss SSDI benefits, which you can view by clicking here. Thank you for your service.
