On Monday we discussed how marriage can affect people who receive Social Security disability benefits either from their own work history or a family member’s. Most people who collect benefits from another person receive them from a parent or spouse. However, it is possible for your former spouse to still collect disability benefits on your record if:

  • You were married to the ex-spouse for a period of at least 10 years
  • The former spouse is unmarried (though you may remarry)
  • Your former spouse is not eligible to collect benefits that equal or exceed the benefit amount from your record.

Certain situations, however, may affect these payments. If your former spouse collects a pension or other funds not payable to Social Security, his or her benefits on your record may be affected. Whether or not your former spouse collects benefits on your record will also have no bearing on the amount of benefits you and any current spouse may receive.
